Cracking the IV-D Code

Fixing the IV-D due process problem is the key to a successful father’s rights movement designed to extract the state from private domestic relations.  The rule of law commands that fathers are afforded due process before the state interferes in the privacy inherent in a father and child relationship.  Citizens Rule has compiled overwhelming evidence that the states have denied millions of fathers (and some mothers) due process protection before it took control of their children under the parens patriae doctrine.

           The heart of the due process problem is the failure of states to include any due process protection for parents conscripted into the IV-D program, based solely on an application filed by an estranged ex-wife or former partner.  State child support enforcement programs do not provide a forum in which one parent my contest the other parent’s allegation that their children are in need of state protection.  The state has unconstitutionally infringed on the natural guardianship right of fathers by not allowing these men to contest the need for state intrusion into their private domestic relations.
